Which Rules Apply To A Kulnura Block

Kulnura is a rural suburb north of Mangrove Mountain along George Downes Drive. Property listings in the area describe RU2 Rural Landscape and RU1 Primary Production land, so check your own zoning on the NSW Planning Portal Spatial Viewer. For rural-zoned land (RU1, RU2, RU3, RU4, RU6 and deferred matter land), the NSW Government’s guidance says clearing native vegetation is guided by the Land Management (Native Vegetation) Code 2018, through Local Land Services, not by council’s tree chapter. Our home page explains where council’s chapter does apply.

Which category your land falls into decides what you need:

Land category What it covers What it means
Category 1, exempt Land cleared as of 1 January 1990, or lawfully cleared after that You can clear native vegetation without Local Land Services approval, as long as you don’t knowingly harm a threatened animal or its habitat. Other approvals, such as council consent, may still apply.
Category 2, regulated Land not cleared by 1 January 1990, or unlawfully cleared since You may need authorisation from Local Land Services.
Category 2, vulnerable regulated Steep land (over 18 degrees), highly erodible land and protected riparian areas Clearing may not be permitted under the Code, and only a limited range of activities is allowed.
Category 2, sensitive regulated High conservation value land, including critically endangered communities and core koala habitat Clearing isn’t permitted under the Code, with a limited range of exceptions.
Excluded land Urban zones, existing developments and protected areas such as national parks The Code doesn’t apply. Council or other approvals may.

You can check your category on the NSW Native Vegetation Regulatory map or the Check My Land app. Some routine farm maintenance, such as certain fence lines and rural infrastructure, falls under “allowable activities” and needs no approval, but not if the work needs development consent.

A dangerous tree near a house or shed is a council question. The NSW Government’s guidance says that clearing native vegetation which may be a risk to human life or property is considered by local government. Our tree removal page explains how council’s process works, and our arborist page explains the evidence it asks for.

Other Approvals That Catch Rural Landowners

Creeks and catchment land

Kulnura sits in the catchment of Mangrove Creek Dam, the largest water supply catchment on the Central Coast. Land within 40 m of a creek bank is waterfront land, and removing vegetation from it may need approval from the state’s water regulator. See our Erina page for how to check.

Burning

If you plan to clear by burning, consult the local Fire Control Officer first. You may need a permit or have to burn at a set time.

Aboriginal objects and survey marks

Scarred trees and other Aboriginal objects are protected, and damaging a survey mark, including a blazed tree, without authority is illegal.

Federal rules changed on 1 December 2025

You should check whether Australian Government approval is needed before clearing native vegetation, especially vegetation 15 years or older, even if you already hold a NSW approval. The NSW guidance points to the national EPBC self-assessment service and 1800 976 422.

Before You Book In Kulnura

  1. Check your zoning on the NSW Planning Portal Spatial Viewer, and your land category on the Native Vegetation Regulatory map.
  2. Check the property title for conditions on clearing. The NSW guidance says they take precedence over the Land Management Act.
  3. Check for steep slopes and creeks on the block, since both can put land in a stricter category.
  4. Decide whether the work is routine maintenance, hazard removal near a building, or larger clearing, and speak to Local Land Services on 1300 795 299 about the last of these. See our land clearing page.
  5. If a storm has brought a tree down, start with our emergency tree removal page.
  6. Decide about the stump. Our stump grinding page covers the options.
